Subject:   Export of Sugar – reintroduction of the system of export release orders w.e.f. 1.1.2009 for export under OGL – reg.

            The Department of Food & Public Distribution, Ministry of Consumer Affairs, Food & Public Distribution, have intimated that the Central Government w.e.f. 1.1.2001 had been regulating the export of sugar through export release order mechanism issued by the Directorate of Sugar.  In view of the excess production of sugar in 2006-07 and 2007-08 sugar seasons and also to facilitate expeditious export of sugar. The requirement of obtaining release orders from the Directorate of Sugar for export of sugar was dispersed with vide Notification No. S.O.4310-(E) dated 31.7.2007 upto 30.09.2008 which was subsequently extended vide Notification No. S.O 2709 (E) dated 21.11.2008 upto 31.12.2008 or till further orders in respect of exports under OGL and till further orders in cases of exports under advance authorization schemes.  It has been further intimated that since production of sugar in 2008-09 sugar season would be substantially less than the last two sugar seasons, it has been decided to reintroduce the system of export release orders w.e.f. 1.1.2009 for export under OGL.  However, the dispensation in respect of exports under advance authorization scheme issued vide Notification No. 2709 (E) dated 21.11.2008 would continue.  

2.         In view of the above, it is directed that all the field formations take necessary action for compliance of the above decision of the Government.

ORDER

 New Delhi, the 12th March, 2009

G.S.R.164(E) – In exercise of the powers conferred by Section 3 of the Essential Commodities Act, 1955 read with the Clause 5 of the Sugar (Control) Order, 1966, the Central Government hereby directs that no recognized dealer of sugar shall hold any stock of vacuum pan sugar for a period exceeding thirty days from the date of receipt by him of such stock and shall not keep in stock at any time vacuum pan sugar, in the places mentioned below, in excess of the quantities mentioned against each

(i)         in Kolkata and extended area -

(a)           recognized dealers who import sugar from outside West Bengal – 10,000 quintals;

(b)           other recognized dealers – 2000 quintals;

(ii)        in other places – 2000 quintals

Provided that nothing in this order shall apply to the holding or keeping of stock of sugar –

(i)           on Government account, or

(ii)          by the recognized dealers nominated by a State Government or an officer authorized by it to hold stock for distribution through fair price shops; or

(iii)         by the Food Corporation of India

 

Provided further that the aforesaid stock holding limit or turnover period of stocks will not apply to sugar importers under open General License.

 

Further, in exercise of powers conferred by Clause 15 of the said Order, the Central Government authorizes the State Governments or Union Territory Administrations to fix the stock holding and turnover limits in their respective States or Union Territories subject to the following conditions –

 

(i)           the stock holding limit and / or the turnover period shall not be less than the limit or period as being specified above by the Central Government; and

(ii)          The stock holding limit of a recognized dealer dealing in retail trade shall be at a level less than that specified for a wholesaler.

 

Explanation: for the purpose of this Notification –

 

(i)           ‘Kolkata and extended area’ means the area specified in the schedule to the notification of the Government or West Bengal No.7752/FS/F/5/14r92/61 dated the 16th December, 1964, and

(ii)          For counting the period of holding of the stock, the date on which any stock is received by the recognized dealer shall be included.

 

2.         This Order shall come into force after fifteen days of its publication in the Official Gazette and shall remain into force for a period of four months thereafter.

S.O.473(E) -  In exercise of the powers conferred by sub-section (3D) of Section 3 of the Essential Commodities Act, 1955 read with clause 4 of the Sugar (Control) Order, 1966, the Central Government, hereby makes the following amendments in the notification of the Government of India, Ministry of Consumer Affairs, Department of Food and Public Distribution, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide No. S.O.1310(E) dated the 31st July, 2007, namely:

 

2.  In the said notification for clause (a), the following clause shall be substituted, namely:

 

"(a)  a producer of sugar by vacuum pan process or a merchant importer-exporter shall be required to obtain an export release order from the Chief Director (Sugar), Directorate of Sugar or any other officer authorised by the Chief Director (Sugar), for export of sugar whether under Open General Licence or Advance Authorization Scheme on 'ton-to-ton' basis or any other scheme permitting export of sugar.

 

Explanation : Where a producer of sugar or a merchant importer-exporter imports raw sugar under advance authorisation scheme and exports processed white or refined sugar for fulfillment of his export obligation under 'grain-to-grain' policy, such producer of sugar or merchant importer-exporter shall not be required to obtain an export release order from the Chief Director (Sugar), Directorate of Sugar."

 New Delhi, the 18th February, 2009

 

            S.O. 509(E).- In exercise of the powers conferred by sub-section (3D) of section 3 of the Essential Commodities Act, 1955 (10 of 1955), read with clause 4 of the Sugar (Control) Order, 1966, the Central Government, hereby directs that a producer of sugar who imports raw sugar on or after 17th February, 2009 and upto 30th September, 2009 under Advance Authorization Scheme and  subject to ton-to-ton policy of the Government in respect of fulfilling export obligation shall  register such imports of raw sugar and exports made to fulfill the export obligations connected with such import on monthly basis in the enclosed proforma within ten working days of the succeeding month.

 

2.         There shall be no levy obligation on such processed raw sugar. White or refined  sugar produced out of the raw sugar processed shall be added to non-levy stocks of the concerned sugar factory and taken into account while releasing the monthly non-levy sugar stocks of the concerned factory.

 

3.         The concerned producer of sugar who imports raw sugar under the ton-to-ton policy and undertakes exports of white or refined sugar to fulfill his export obligation shall be required to obtain an export release order from the  Chief Director (Sugar), Directorate of Sugar or any officer authorized by the Chief Director (Sugar).

S.O. 2709(E).- In exercise of the powers conferred by sub-section (3D) of Section 3 of the Essential Commodities Act, 1955 (10 of 1955), read with clause 4 of the Sugar (Control) Order, 1966, the Central Government hereby makes the following amendments in the notification of the Government of India, Ministry of Consumer Affairs, Food and Public Distribution, Department of Food and Public Distribution, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 1310(E), dated the 31st July, 2007, namely:-

 

2.         In the said notification, for clause (a), the following clause shall be substituted, namely:

            “(a)      a producer of sugar by vacuum pan process shall be free to dispatch  non-levy sugar for the purpose of export in 2008-09 sugar season, under the Open General License upto 31st December, 2008 or till further orders, whichever is earlier and till further orders, under the Advance License Scheme.

            Explanation.- For the removal of doubts, it is hereby declared that this clause shall apply for advance license holders who imported raw sugar between  21st September, 2004 and 15th April, 2008, subject to the rules, orders and instructions which the Directorate General of Foreign Trade, Ministry of Commerce and Industry, have specified or may specify for fulfillment of their export obligation.”

NOTIFICATION

                        New Delhi, the 25th February, 2008

S.O.  392(E)  --  In exercise of the powers conferred by sub-section (1) of Section 3 of the Sugar Cess Act, 1982, the Central Government hereby notifies that there shall be levied and collected as a cess for the purpose of Sugar Development  Fund Act, 1982, a duty of excise on all sugar produced by any sugar factory in India at a rate of twenty four rupees per quintal of sugar.

2 .        The above rate shall come into force with effect from 1st March, 2008 and will apply on sugar dispatched or delivered on or after such date.
